Abstract

This article explores the concept of Alternative Dispute Resolution (ADR), its implementation, impact, and enforcement in the legal system of Pakistan, with a focus on arbitration, mediation, conciliation, and negotiation. ADR is increasingly recognized as a viable alternative to traditional litigation, offering faster, cost-effective, and less adversarial methods for resolving disputes. The study examines the mechanisms through which ADR is implemented globally and regionally, highlighting the legislative frameworks of Pakistan and England along with the role of international instruments like the UNCITRAL Model Law. It also highlights the various technical challenges and their solution related to ADR and enforcement of arbitral awards.
